1. Introduction

    Stefania Stroppiana, owner of the brand Stefania Esse, has drafted the following General Terms and Conditions of Purchase (hereinafter, the “Conditions”) governing the sale of items offered through the Online Shop at https://www.stefaniaesse.com.

    These Conditions constitute the commercial agreement between the User (hereinafter, the “Customer”) and Stefania Stroppiana.

    The Conditions expressly, clearly, and unequivocally establish:

    • the identity of the Online Shop owner,

    • the characteristics of Stefania Esse items,

    • applicable prices and charges,

    • methods of payment,

    • the purchasing procedure,

    • guarantees and returns,

    • and all other circumstances related to the purchase of Stefania Esse items.

    All Stefania Esse items offered for sale in the Online Shop are sold directly by Stefania Stroppiana, whose business is registered at Albavägen 36, 18133, Lidingö, Sweden, VAT identification number SE800223822101, and who is the rightful owner of the Stefania Esse brand.

    By placing an order, the Customer expressly accepts these Conditions as well as the Privacy & Data Protection Policy and the Legal Notice available on https://www.stefaniaesse.com. Should the Customer not provide such consent, it may be impossible to register, browse the website, or complete an order.

    Stefania Stroppiana reserves the right to modify these Conditions at any time and without prior notice; Customers are therefore advised to review them each time they intend to place an order.

    The Online Shop is available 24 hours a day, every day of the year. Minors are not permitted to place orders.

     

    1.  Registration in the Online Shop

      Purchases may only be made as a registered Customer.

      To register, the Customer must complete a form providing personal data, which can be updated at any time. Through their account, registered Customers may:

      • manage purchases,

      • track orders,

      • review purchase history,

      • and, where available, create one or more wish lists, request personal shopping advice, receive periodic newsletters, and take part in promotions.

      The data provided will be incorporated into the Stefania Esse database for the purpose of processing orders and facilitating future purchases in the Online Shop.

      Once registration is complete, Customers may access their private account area by entering their username and password. Registered Customers may request automatic recognition by selecting the “REMEMBER ME” option, which streamlines the purchasing process and allows direct access to their data without repeated identification. Automatic recognition is enabled through cookies, in accordance with the Privacy and Data Protection Policy.

      If a registered Customer has requested automatic recognition, they will only be required to identify themselves again if they connect to the Online Shop from a different device or after deleting temporary Internet files (cache and/or cookies).

      The Customer’s email address and password are strictly personal and confidential. The registered Customer is responsible for keeping these details secret and secure. Unless proven otherwise, Stefania Stroppiana will assume that any use of the account and purchases made using these credentials have been carried out by the Customer personally, unless the Customer has previously notified Stefania Stroppiana of their loss or theft via email at customercare@stefaniaesse.com.

      Registered Customers may change their email and password following the procedures provided by Stefania Stroppiana. Once new credentials are generated, the old ones will be invalidated.

      Stefania Stroppiana reserves the right to block access to or use of the Online Shop when deemed necessary for security reasons, in cases of suspected fraud, or in the event of a breach of obligations.

      If a registered Customer enters an incorrect password, a link will appear to initiate the password recovery process.

      Failure to provide correct personal data will prevent registration as a Customer in the Online Shop.

      All personal data provided are subject to our Privacy and Data Protection Policy. Registration cannot be completed without accepting these Conditions of Purchase.

    2. Customer Obligations

      The Customer undertakes to:

      1. Provide accurate data – Supply Stefania Stroppiana with correct and complete personal details necessary for the shipment and delivery of orders.

      2. Maintain security – Adopt all necessary personal and technical measures to keep their password confidential. Any loss, theft, misappropriation, or unauthorized access must be immediately reported to Stefania Stroppiana. The Customer must also notify if their password becomes known to third parties.

      3. Fulfil payment obligations – Pay in full for Stefania Esse items purchased through the Online Shop, including any applicable shipping costs.

      4. Avoid fraudulent use – The Customer must not place fraudulent, false, or speculative orders. Stefania Stroppiana reserves the right to cancel such orders and/or notify the relevant authorities where there are reasonable grounds for suspicion.

      5. Respect the operation of the Online Shop – Refrain from undertaking any activity that disrupts, interferes with, or attempts to impair the proper functioning of the Online Shop.

    1. Delivery Areas

      Stefania Esse items are shipped exclusively to the countries where the Online Shop is available (see the complete list).

      Accordingly, shipping costs may vary depending on the destination.
      The system will automatically detect the country of access to ensure correct delivery options are applied.

    1. Purchase Procedure

      To purchase one or more Stefania Esse items, the Customer must first register with the Online Shop, subject to the following provisions:

      • Product details: description, reference number, size, characteristics, colours, composition, and product image.

      • Unit price.

      • Shipping costs.

      • Validity of the offer, where applicable.

      Once the desired item has been selected, the Customer must add it to the cart by clicking the “ADD TO CART” button, specifying for each item the quantity, size, colour, etc.

      After adding the chosen products to the cart, the Customer can review a summary of selected items by clicking “CART” at the top right of the page. The following details are displayed, and the Customer may adjust quantities or remove items:

      • Stefania Esse items.

      • Description.

      • Quantity.

      • Unit price.

      • Total price of each purchased item.

      • Total purchase price.

      • Shipping costs.

      To finalise the purchase, the Customer must click “PROCEED TO CHECKOUT”.

      • If the purchaser is a registered Customer, they must provide the email and password previously supplied.

      • The Customer will then proceed to the “PAYMENT DETAILS” stage, where payment, shipping, and billing details must be entered, reviewed, and confirmed.

      If the Customer holds a promotional code or online voucher, this must be entered at this stage to benefit from applicable conditions or discounts.

      The Customer will then select a payment method from those available and provide the necessary details.

      To confirm the purchase, the Customer must accept the Conditions of Purchase by ticking the corresponding box and clicking “ACCEPT”.

     

    1. Acceptance of the Order

      The sales agreement shall not be deemed formalised until Stefania Stroppiana has accepted the order (even if the Customer’s account has already been charged).

      In the event that the order is not accepted, but the corresponding amount has already been charged to the Customer’s account, the full amount will be refunded within a maximum of fifteen (15) business days.

      After clicking “CONFIRM AND PAY”, the Customer will receive an “Order Confirmation” email containing the details of their purchase. Failure to receive this message may be due to temporary communication issues or a typing error in the email address provided. In either case, the Customer is requested to notify Stefania Esse by email at customercare@stefaniaesse.com.

      The receipt of the “Order Confirmation” email does not imply acceptance of the order, but merely acknowledges the Customer’s proposal to purchase from Stefania Stroppiana.

      All orders are subject to acceptance by Stefania Stroppiana, of which the Customer will be informed by email, through the “Your order has been shipped” confirmation. The transaction between Stefania Stroppiana and the Customer shall only be deemed formalised upon dispatch of the “Shipping Confirmation”.

      This agreement shall cover only the Stefania Esse items described in the Shipping Confirmation.

      Stefania Stroppiana reserves the right to refuse to process orders that:

      • do not provide sufficient solvency guarantees,

      • are incomplete or incorrect, or

      • concern Stefania Esse items that are not available.

      In such cases, Stefania Stroppiana shall not be liable to the Customer or any third party. Nevertheless, the Customer shall be duly notified and, if payment has already been made, the corresponding amount refunded.

     

    1. Currency, Payment Methods, and Applicable Taxes

      Prices are indicated in Euro (€). In accordance with applicable legislation, every purchase made through the Online Shop may be subject to all applicable taxes.

      For further information, the Customer is invited to contact Stefania Stroppiana’s Customer Service by sending an email to customercare@stefaniaesse.com.

      Stefania Stroppiana undertakes to ensure that the information contained on this website is accurate and free from errors. Should such errors occur at any time, they will be corrected immediately. Stefania Stroppiana reserves the right to modify the prices on the website without prior notice. At all times, the price of an item shall be the one indicated on the Online Shop, except in cases of obvious error.

      Although Stefania Stroppiana strives to ensure that there are no errors in the prices listed on the site, in the event of a pricing error on an item ordered by the Customer, Stefania Stroppiana will notify the Customer as soon as possible, offering the option to reconfirm the order at the correct price or to cancel it. If Stefania Stroppiana is unable to contact the Customer, the order will be cancelled and any amount already paid fully refunded, without entitlement to compensation.

      Stefania Stroppiana shall not be obliged to supply item(s) at an incorrectly lower price (even if the Customer has received an order confirmation email), where the pricing error was obvious and unmistakable. In such cases, the reference price shall be the official price of the Stefania Esse item at an authorised Stefania Esse retailer in the country where the order was placed or, if not available, the official retail price in Sweden.

      Stefania Stroppiana accepts payments by bank transfer and PayPal. In accordance with applicable legislation, any payment instruction made by credit or debit card is irrevocable. By entering their card details, the Customer authorises the charge to be made to the card.

      All payments are processed through a secure payment gateway that encrypts card and PayPal data. To ensure maximum payment security, Stefania Stroppiana relies on secure payment systems provided by leading financial institutions in e-commerce. In this regard, confidential payment information is transmitted directly and securely (SSL) to the corresponding financial institution.

      For Visa and MasterCard payments, Stefania Stroppiana has implemented the SEC (Secure Electronic Commerce) service with the international 3D Secure protocol, identified by the logos Verified by Visa and MasterCard SecureCode. The principle of Secure Electronic Commerce is to ensure the highest level of online transaction security. When a payment is made through the secure payment gateway, the system automatically verifies that the credit card is enabled for Secure Electronic Commerce. It then connects with the issuing bank, which requests authorisation for the transaction using a personal authentication code. The transaction is approved only if the issuing bank confirms the authentication code; otherwise, it will be denied.

      As an additional security measure to prevent online fraud, Stefania Stroppiana reserves the right to verify the personal information provided by the Customer and to adopt any measures deemed necessary (including order cancellation) to ensure that the merchandise is delivered in accordance with the details provided in the order.

    1. Availability of Items

      The Customer acknowledges that the items offered by Stefania Esse through its Online Shop are subject to stock availability.

      In the event that any Stefania Esse item is unavailable at the time of ordering, the Customer will be notified as soon as possible. At that point, the Customer will have the option to modify the order or cancel it.

      Stefania Stroppiana reserves the right to modify the items offered for sale through the Online Shop at any time and without prior notice.

     

    1. Shipping and Delivery of Items

      The sale and delivery of items is available only to the countries listed on the website (see list). The delivery country must always correspond to the country of the Online Shop used by the Customer to place the order.

      Stefania Stroppiana offers a single shipping method (DHL Express Delivery Service), with different delivery options available depending on the destination country, as specified below:

      • Home Delivery: Shipment of items is carried out by a courier selected by Stefania Stroppiana. Items are delivered to the address indicated by the Customer at the time of completing the order.

      The order will be delivered within the timeframe indicated below. Stefania Stroppiana makes every reasonable effort to ensure that the service is provided in the shortest possible time. Once the order leaves Stefania Stroppiana’s warehouses, the Customer will receive a confirmation email of the shipment. Registered Customers may track their orders in the “ACCOUNT” area by clicking on “MY ORDERS.”

      For security reasons, Stefania Stroppiana does not deliver to P.O. boxes, nor does it accept orders where it is not possible to identify the recipient and/or the delivery address. Responsibility for the Stefania Esse items passes to the Customer upon delivery of the order.

      If the order cannot be delivered because the Customer is absent, the package will be returned to the central warehouse. This is considered a refusal of its contents by the Customer, who will not be entitled to claim compensation for the order in question. Once the order has been returned to the Stefania Esse warehouse, Stefania Stroppiana may, in good faith, reimburse the Customer, deducting from the refund the shipping and return costs incurred due to the Customer’s failure to collect the shipment. Should the Customer wish to receive the order again, they must repeat the purchase procedure.

    Note: Delivery times are calculated in working days only (excluding weekends and public holidays), starting from the moment the order leaves the Stefania Esse warehouses. The Customer’s order will be delivered within the agreed time frame, from the date the order leaves the warehouse.

    Orders will be shipped to the delivery address provided by the Customer at the time of purchase. It is therefore important that Customers exercise the utmost care when entering their shipping details, as once the order has been completed, it is not possible to modify these details.

    Stefania Stroppiana is not responsible for incorrect or incomplete shipping addresses.

    For security reasons, Stefania Stroppiana does not deliver to P.O. boxes, nor accept orders where the recipient and/or address cannot be identified.

    Responsibility for Stefania Esse items transfers to the Customer upon delivery of the order.

    1. Delivery Issues

      If the Customer has not received the order within ten (10) working days from the date of receiving the shipping confirmation notice, the Customer undertakes to notify Stefania Stroppiana.

      Upon delivery of the order, the Customer is required to verify that everything corresponds to what was requested. In the event of discrepancies or any problem related to the order, the Customer must notify Stefania Stroppiana by email at customercare@stefaniaesse.com within no more than twenty-four (24) hours of receipt.

      This email must include the Customer’s personal details and the order identification number, together with a detailed description of the discrepancies or issues encountered. Stefania Stroppiana will then contact the Customer as soon as possible in order to resolve the matter.

     

    1. Discount Codes

      Stefania Stroppiana may offer discount codes to its Customers; such codes apply exclusively to purchases made through the account for which the code was issued and registered.

    1. Cancellation, Exchange & Return Policy

      Right to Cancel an Order – Right of Withdrawal

      Customers are entitled, within fourteen (14) calendar days from the date of receipt, to cancel their order by sending an email to customercare@stefaniaesse.com, notifying their cancellation and indicating the following subject line: “Notice of Cancellation of Order No. [insert order number]”. Customers may also use the cancellation form included in the Appendix to these Conditions, although this is not mandatory, as the contract may be terminated by any clear declaration (e.g., letter, fax, or email).

      The Customer must be able to demonstrate that they exercised this right within the 14-day period. After receiving the cancellation request, Stefania Stroppiana will send the Customer an email containing a cancellation number. The Customer must indicate this cancellation number on the delivery note accompanying the returned Stefania Esse items.

      The right of cancellation may be exercised provided that returned Stefania Esse items are in the same condition as when received, with all original packaging, tags, and related accessories. The only address to which Stefania Esse items may be returned is:

      Albavägen 36, 18133, Lidingö, Sweden.

      Stefania Stroppiana recommends that the Customer use a secure and trackable method for returning cancelled orders, as the Customer is solely responsible for any damage to Stefania Esse items occurring prior to their arrival at Stefania Stroppiana’s warehouse. Return costs are borne by the Customer. Proof of shipment must be kept in case of unforeseen circumstances. Upon receipt, the returned items will be inspected to verify that they are in the same condition in which they were originally delivered.

      Refunds will not be issued for items returned damaged, incomplete, worn, or soiled; such items will either be resent to the Customer at their expense or made available for collection at Stefania Stroppiana’s warehouse for a maximum period of sixty (60) calendar days. After this period, the items will be considered abandoned, and the Customer will have no right to compensation. Stefania Stroppiana accepts no liability for the storage of improperly returned items during this period.

      In the event of cancellation, Stefania Stroppiana will refund all payments received, including standard shipping costs (excluding any additional charges where the Customer selected a delivery method other than the standard rate, if multiple options were available), without undue delay and in any case no later than fourteen (14) calendar days from the date of notification of contract withdrawal.

      If the Customer returns only part of the order, this will not constitute cancellation of the contract but a partial return. In such case, Stefania Stroppiana will refund only the amount corresponding to the returned items, excluding shipping costs.

      Refunds will be processed using the same payment method used for the original transaction. The Customer will not incur additional charges for the refund, except for return shipping costs, which are their responsibility.

      Refunds may be withheld until the goods are received or until the Customer provides proof of return shipment, whichever occurs first. The Customer must return the items within fourteen (14) calendar days from the date of cancellation notice.


      Exchanges & Returns

      In addition to the regulations governing distance selling, Stefania Stroppiana allows Customers to return or exchange items (for a different size or colour) within fifteen (15) calendar days of receiving the order, subject to the following requirements:

      • Items must be in perfect condition, in their original packaging, and with all tags attached.

      • Returns must include the delivery note originally included in the shipment, with the assigned return number clearly indicated.

      Procedure for exchanges and returns:

      1. Log into your account using your email and password. Select ORDER DETAILS and then EXCHANGE OR RETURN.

      2. Select the item(s) to be returned or exchanged and confirm the choice. For an exchange, indicate the reason and the new size and/or colour.

      3. For returns, select the refund method (store credit or refund to the original payment method) and ship the items back to our warehouse at your own expense.

      4. Confirm the exchange/return. The system will generate a return/exchange number to identify the process.

      5. Write the assigned return number on the delivery note or, if unavailable, on the outside of the original box. Insert the items inside the original box for return.

      The processing of an exchange or return does not constitute final acceptance of the items, which are subject to inspection for compliance with return conditions.

      For hygiene reasons, jewellery, lingerie, swimwear, and hosiery cannot be exchanged or returned.

      Refunds to the original payment method will be made in accordance with the conditions of the Customer’s bank. Credit card refunds are normally credited at the time of processing, while debit card refunds may take up to thirty (30) working days.

      Refunds will not be accepted for items that, for reasons attributable to the Customer, are returned damaged, incomplete, worn, or soiled. Such items will either be resent to the Customer at their expense or made available for collection within sixty (60) days. After this period, they will be considered abandoned, without any right to compensation.

      Stefania Stroppiana reserves the right to reject returns that do not comply with these conditions.

      Returns Due to Errors or Defective Items

      If an order contains an error in size, colour, or model, the Customer must immediately notify Stefania Stroppiana by email at customercare@stefaniaesse.com, providing full details.

      If an item is defective or faulty, the Customer must also notify Stefania Stroppiana as soon as possible. Returned goods will be examined, and within five (5) working days the Customer will receive an email confirming whether a refund or replacement applies.

      Refunds or replacements will be processed as quickly as possible, and in any case within thirty (30) calendar days from the confirmation email. In such cases, Stefania Stroppiana will bear the transportation costs of return and replacement.

      If replacement is not possible, the Customer will be entitled to a full refund, credited to the same payment method used for the original transaction.


      Outlet, Flash Sales & Promotions

      From time to time, previous collection items may be offered at special prices in the form of outlet sales, flash sales, or other promotions. Due to high demand, preparation time may be extended.

      Return requests for items purchased during flash sales must be submitted within fifteen (15) calendar days of receipt. Return costs, which vary depending on country and method, are borne by the Customer. Size or colour exchanges are not possible for these items.

      Processing of returns and refunds during sales periods may take 8–10 days. Refunds will be issued to the same payment method used for the original transaction.


      Liability and Limitation of Liability

      Stefania Stroppiana’s liability arising from any item purchased on https://www.stefaniaesse.com is strictly limited to the purchase price of the item.

      To the maximum extent permitted by law, and except as otherwise expressly provided in these Terms and Conditions, Stefania Stroppiana disclaims liability for any indirect damages, including incidental losses or damages resulting from tort (including negligence), breach of contract, or otherwise, even if foreseeable.

      All descriptions of items, information, and materials appearing on this website are provided “as is,” without express or implied warranties.

      This clause does not affect the Customer’s statutory rights as a consumer, nor their right to withdraw from this contract.

      Complaint forms are available to Customers upon request from Customer Service at customercare@stefaniaesse.com.

      Products purchased are covered by a two-year legal warranty from the date of delivery, excluding defects caused by improper use, treatment, or normal wear and tear. To exercise this warranty, proof of purchase is essential.


     

    13. Events Beyond the Control of Stefania Stroppiana

    Stefania Stroppiana shall not be held liable for any failure or delay in the performance of obligations under this agreement caused by events beyond its reasonable control (“Force Majeure”).

    Force Majeure shall include, but is not limited to:

    • Strikes, lockouts, riots, invasions, or terrorist attacks.

    • Fires, explosions, storms, floods, earthquakes, collapses, epidemics, or any other natural disaster.

    • Impossibility of using trains, ships, aircraft, motor transport, or other public or private means of transport.

    • Impossibility of using public or private telecommunications systems.

    • Acts, decrees, legislation, regulations, or restrictions imposed by any government.


    14. Personal Data Protection – Privacy and Confidentiality

    Stefania Stroppiana guarantees that all personal data shall be processed in compliance with applicable legislation governing information society services and electronic commerce. Appropriate technical and organisational security measures have been adopted within its facilities, systems, and files.

    To purchase Stefania Esse items, Customers must provide their personal data, which must be truthful, accurate, up-to-date, and complete. By purchasing and accepting these Terms & Conditions, the Customer is deemed legally informed and expressly authorises Stefania Stroppiana to store and process their personal data provided at the time of purchase, as well as data derived from use of the service (including purchase history), and IT processes, for the purposes of fulfilling the Customer’s requests and for commercial purposes such as segmentation, market research, and profiling.

    This may enable discounts, promotions, or special offers, and the Customer may also receive promotional communications, the sending of which by email is expressly authorised upon registration.

    As the protection of data and privacy is of the utmost importance to Stefania Stroppiana, Customers are strongly encouraged to review the Privacy & Data Protection Policy available on https://www.stefaniaesse.com.


    15. Partial Invalidity

    If any part of these General Terms and Conditions is declared null, void, or unenforceable, the validity and enforceability of the remaining provisions shall not be affected, which shall remain binding upon both parties.

    The failure by either party to exercise any right under these Conditions shall not constitute a waiver of any other rights, nor create an acquired right for the other party.


    16. Notices

    Certain communications sent to the Customer may be provided in both paper and electronic format. By accepting these Terms, the Customer consents to this method of communication.

    Such communications shall be deemed duly made when published on the Website, 24 hours after an email has been sent, or three (3) working days after the date of postal stamp if sent by letter.

    18. Jurisdiction and Governing Law

    These Terms & Conditions are governed by Swedish law. The parties submit to the exclusive jurisdiction of the Courts and Tribunals of Stockholm, Sweden, to resolve any doubts, discrepancies, or disputes arising from the performance or interpretation of this contract.


    19. Privacy Policy

    As the security and protection of Customers’ personal data is a priority for Stefania Stroppiana, Customers are advised to carefully review the applicable Privacy Policy.
